Funding for First Nations with claims at the Specific Claims Tribunal of Canada │Crown-Indigenous Relations and Northern Affairs Canada (CIRNAC)

Description

Crown-Indigenous Relations and Northern Affairs Canada can provide funding to support First Nations who choose to file a specific claim with the Specific Claims Tribunal of Canada.

Eligible Applicants

First Nations who have filed a specific claim with the Specific Claims Tribunal can apply for funding.

First Nations can file a specific claim with the tribunal in one of four situations, if:

  • a claim has not been accepted for negotiation by the Government of Canada
  • the Government of Canada fails to advise the First Nation within three years of filing its claim with the Minister of Crown-Indigenous Relations and Northern Affairs whether the claim will be accepted for negotiation
  • all parties agree
  • three years of negotiations do not result in a final settlement

Eligible Expenses

All funding support will be provided based on an approved descriptive budget submitted by the eligible recipient. All eligible expenses should be reasonable and consistent with activities required to comply with the rules of practice and procedure of the tribunal.

Examples of eligible expenses include, but are not limited to the following:

  • attending tribunal proceedings such as:
    • case management conferences
    • pre-hearing conferences
    • hearings
    • oral examinations
  • legal expenses relating to tribunal proceedings such as:
    • case management conferences
    • pre-hearing conferences
    • hearings
    • oral examinations
    • preparation of witnesses
    • preparation and review of documentation
  • expenses relating to witnesses and interpreters who attend tribunal proceedings such as:
    • case management conferences
    • pre-hearing conferences
    • hearings
    • oral examinations

A First Nation may apply for contribution funding to cover eligible expenses listed above more than once, if it is deemed required by the tribunal. For example, there may be multiple case management conferences required so the First Nation can apply for the expenses for each case management conference.

Deadline Date

There is no deadline. First Nations may apply for funding as soon as their specific claim has been filed with the tribunal. However, it is recommended to apply by January 1 of each year as funding is limited.
